Lawsuit Filed by Peruvian Farmer against RWE: Claimant Aims for a Widespread Impact - Farmer in Peru sues RWE, seeking corporate acknowledgment of climate responsibility
A Peruvian farmer, Saúl Luciano Lliuya, has formally lodged a lawsuit against RWE, a German energy company, seeking financial compensation for protective measures against potential flooding of his Huaraz residence. His house is situated in a vicinity where the Andean lake Palcacocha is feared to experience overflow due to glacier melting, causing a flood wave. Lliuya accuses RWE of partial responsibility for the potential disaster, given its status as a significant emitter of greenhouse gases. The environmental advocacy group, Germanwatch, backs Lliuya in this lawsuit.
The court, during a trial in Hamm, Germany, will first determine if there is a substantial danger to Lliuya's house to warrant further proceedings. In mid-March, experts testified in court, having been sent to Peru for an evaluation. The court's expert, Rolf Katzenbach, estimated the likelihood of a flood wave within the next 30 years at about 1%. If the court adopts this opinion, the lawsuit would be deemed unfounded and the appeal dismissed, as suggested by RWE's representative. The company also objects to the idea of assigning specific climate impacts to a single emitter.
Lliuya and Germanwatch, however, demand proportionate participation from RWE in implementing protective measures against potential floodwaves. They base their argument on RWE's share of global greenhouse gas emissions since the beginning of the industrial age, estimated at 0.38%.
